Is this a tax scam that will get me into trouble?

No.  The 280A tax write-off is straight out of the U.S. Tax Code under 280A.  It is a bona fide tax write-off for business use of the home.  However, like all other tax write-offs, there are certain conditions and limitations to the 280A.

Our staff of CPAs and Tax Attorneys has set up the guidelines to keep you out of trouble and to defend you if you operate within these guidelines.

Should I do this although my CPA isn’t comfortable with it?

CPAs are not always the most accurate indicator of what is reasonable or not.  CPAs put their license “on the line” when they process your taxes or have a hand in your finances.  Hence, if you are working with a CPA, they are going to get paid whether they include the 280A write-off or not.  Therefore, if they are getting paid whether or not they get you “this” tax write-off, then why would they risk their license; or at minimum, why risk anything?  If this is your case, it’s probably time you look for a CPA who is willing to “go to bat for you”, and earn his keep.
